PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PURCHASING OR PARTICIPATING IN ANY SERVICE, PROGRAM, OR PRODUCT OFFERED BY KAYLA ANDERSON, TRADING AS LOVE WITH KAYLA ANDERSON ("COMPANY", "WE", "US", OR "OUR"). BY ENROLLING IN, PURCHASING, OR ACCESSING ANY SERVICE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS.

IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST NOT ACCESS OR USE OUR SERVICES AND MUST DISCONTINUE ANY EXISTING ENROLMENT IMMEDIATELY.

These Terms and Conditions apply to all services, products, programs, and digital content offered by Kayla Anderson, including but not limited to: the Beyond, Heart-Led, Heart-Led Gold, 1:1 Coaching, Cacao Ceremony, Sacred Socials, all Live Events and Retreats and all other programs, digital products, self-study courses, workshops, ceremonies, and offerings available through www.lovewithkaylaanderson.com, www.withkaylaanderson.com, or any associated platform.

1. INTERPRETATION

The following definitions apply throughout these Terms and Conditions:

1.1 "Company", "we", "us", "our" means Kayla Anderson, trading as Love with Kayla Anderson, a business registered in New Zealand (NZBN: [INSERT]).

1.2 "Client", "Participant", "you", "your" means the individual who purchases, enrolls in, or participates in any Service offered by the Company.

1.3 "Services" means all products, programs, sessions, digital content, ceremonies, and any other offerings provided by the Company, whether in-person or online, including but not limited to: Beyond, Heart-Led, 1:1 Coaching, masterclasses, workshops, immersions, online courses, digital downloads, retreats and any and all future offerings.

1.4 "Digital Offerings" means any online programs and any other entry-level/self-paced or introductory digital products or programs offered by the Company.

1.5 "Group Programs" means any group coaching, mentorship, or healing programs offered by the Company.

1.6 "1:1 Coaching" means individual private coaching or mentorship sessions provided by Kayla Anderson on a one-to-one basis.

1.7 "Ceremonies & Events" means Cacao Ceremony, Sacred Socials, and any other in-person or online ceremony, gathering, or event experience (including retreats) offered by the Company.

1.8 "Products" means any self-study course, workshop recording, digital download, masterclass, or other offering that does not fall within the definitions of Group Programs, 1:1 Coaching, or Ceremonies & Events.

1.9 "Content" means all materials including text, video recordings, audio recordings, workbooks, guides, meditations, module content, photographs, and other intellectual property made available through the Services.

1.10 "Confidential Information" means any personal, financial, emotional, or business information shared by either party in connection with the Services.

1.11 "Payment Default" means a failure to make any scheduled instalment payment within 72 hours of its due date.

1.12 "Site" means www.lovewithkaylaanderson.com, www.withlovekaylaanderson.com, and any associated platform used to deliver the Services.

2. OUR SERVICES

Kayla Anderson provides transformational love coaching, feminine energy guidance, and sacred ceremony facilitation. Services are designed to support women in cultivating deep self-love, aligned relationships, heart-led leadership, and embodied feminine energy, delivered in both individual and group formats online and in person.

Our offerings include, but are not limited to: the Beyond program, Heart-Led Programs, private 1:1 coaching, Cacao Ceremonies, Sacred Socials, Retreats, Events and related digital products and teachings.

The information and tools provided through our Services are intended for personal development, spiritual growth, and general wellness purposes. They do not constitute medical, psychological, legal, or financial advice, and are not a substitute for professional medical, mental health, or therapeutic treatment.

All Services are subject to availability. We reserve the right to modify, update, restructure, or discontinue any Service at any time, with reasonable notice provided where practical.

3. ELIGIBILITY

By purchasing or accessing any Service, you confirm and warrant that:

You are at least 18 years of age;
You have the legal capacity to enter into a binding agreement;
All information you provide is accurate, current, and complete;
You are not relying on our Services as a substitute for professional medical, psychological, or therapeutic care;
You understand that results from the Services are not guaranteed and will vary between individuals; and
You are voluntarily choosing to participate in these Services.

Our Services are intended for individuals who are emotionally and physically stable enough to engage with transformational, somatic, and ceremonial practices. If you have any concerns about your suitability, please contact us before enrolling.

4. INTELLECTUAL PROPERTY RIGHTS

4.1 Ownership

All Content created and provided by Kayla Anderson through the Services — including but not limited to coaching frameworks, ceremony protocols, meditations, workbooks, videos, audio recordings, templates, written materials, and branding — is the exclusive intellectual property of Kayla Anderson and is protected by Australian and international copyright laws.

4.2 Personal Use Licence

Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Content solely for your own personal, non-commercial purposes. This licence does not confer ownership.

4.3 Prohibited Uses

You may NOT, without prior written consent from Kayla Anderson:

Share, distribute, reproduce, resell, publish, or publicly display any Content;
Share your login credentials or access links with any other person;
Record any live sessions (group or 1:1) without express written permission;
Use any Content to create competing products or services;
Use any Content for commercial purposes; or
Adapt, translate, or create derivative works from any Content.

Any breach of this clause will constitute a material breach of these Terms and may result in immediate termination of your access without refund, and legal action may be pursued.

4.4 Your Submissions

Any feedback, testimonials, ideas, or suggestions you provide to us may be used by Kayla Anderson for the improvement or promotion of the Services, without compensation or credit to you, unless otherwise agreed in writing.

5. DIGITAL PROGRAMS

5.1 Program Overview

All digital self-lead programs are entry-level programs designed to support women in stepping into their magnetic, feminine essence. Program inclusions, format, and delivery details are outlined at the point of sale.

5.2 Access

Upon purchase, you will be granted access to the Content for the period specified at the point of sale. Access periods may be limited and are non-transferable.

5.3 All Sales Final

All purchases are final. Due to the immediate digital delivery and intellectual property nature of these products, no refunds will be issued except as required by applicable Australian Consumer Law.

5.4 No Sharing or Resale

All programs are licensed for the sole personal use of the purchasing individual. You may not share access, login credentials, or any Content from these products with any other person, nor may you resell, reproduce, or redistribute any Content.

6. GROUP PROGRAMS

6.1 Program Overviews

Group Programs are a transformative group program guiding women to fully love and embrace their lives through the integration of feminine energy, self-love practices, and heart-centered living.

Kayla designs group programs supporting women in leading from the heart — in relationships, business, and everyday life — through embodied feminine wisdom and energetic alignment.

Whether they are leadership-focused group containers for women ready to build a life and business rooted in love, authenticity, and aligned purpose or relationship/personal focused containers.

Program inclusions, format, call schedules, and deliverables are outlined at the point of sale or in any applicable Program Agreement.

6.2 Financial Commitment

By enrolling in any Group Program:

You agree to pay the full program investment or complete your agreed payment plan;
If a payment plan is selected, all instalments remain payable regardless of continued participation;
Discontinuing participation does not release you from your payment obligations for any remaining instalments.

6.3 Group Environment

Group programs are shared learning and healing spaces. You agree to:

Treat all other participants with respect, compassion, and dignity;
Maintain the confidentiality of all personal information shared by other participants within the group container;
Refrain from recording group sessions without written consent from Kayla Anderson and all participants;
Refrain from promoting your own products, services, or other programs within group spaces without express permission from Kayla Anderson; and
Participate in a manner that supports a safe, loving, and positive container for all.

Kayla Anderson reserves the right to remove any participant from a group program at her sole discretion for conduct that disrupts the container or violates these Terms, without refund.

6.4 No Guarantee of Results

While Kayla Anderson is committed to delivering the highest quality coaching and support, participation in any Group Program does not guarantee specific relationship outcomes, personal transformation milestones, or any other metric of success. Results depend on each participant's individual effort, readiness, and circumstances.

7. 1:1 COACHING

7.1 Scope of Services

1:1 Coaching sessions are tailored to the individual client. The scope, format, duration, inclusions, and deliverables of a 1:1 coaching engagement will be outlined in a separate Client Agreement provided at the time of engagement. In the event of any conflict between these Terms and your Client Agreement, the Client Agreement shall prevail.

7.2 Financial Commitment

Where a 1:1 Coaching engagement involves a multi-session package or payment plan, you acknowledge that:

You are entering into a financial commitment for the full package or agreed investment;
Should you choose to discontinue participation at any time, you remain liable for all remaining scheduled payments under your agreed plan;
No refunds will be issued on payments already made; and
Discontinuation of sessions does not extinguish your financial obligation.

7.3 Cancellations & Rescheduling

Session cancellations or reschedule requests must be made with at least [INSERT] hours' notice. Cancellations made with less than [INSERT] hours' notice may forfeit the session fee, at Kayla Anderson's discretion. Repeated late cancellations or no-shows may result in termination of the coaching engagement without refund.

7.4 Confidentiality

All personal sharing within 1:1 coaching sessions will be held in confidence by Kayla Anderson in accordance with Section 14 of these Terms.

8. CEREMONIES, RETREAS & EVENTS:

8.1 Event Overview

Cacao Ceremony is a sacred, heart-opening ceremonial experience using ceremonial-grade cacao as a plant medicine ally, facilitated in a held, intentional container.

Sacred Socials are curated community gatherings designed to bring women together in sacred, heart-led connection and community.

Live Events and Retreats will be designed and advertised at the time and will focus on varying different methods of healing and support.

8.2 Cacao & Plant Medicine Disclaimer

By participating in any Cacao Ceremony, you acknowledge and agree that:

You have disclosed any known medical conditions, medications, or health concerns to Kayla Anderson prior to the ceremony, including but not limited to: heart conditions, MAOIs or antidepressants, pregnancy, anxiety disorders, or any condition that may be affected by cacao or altered states;
You have consulted with a healthcare professional if you have any concerns about your suitability to participate;
Ceremonial cacao may produce emotional, physical, and energetic responses including emotional release, heightened sensitivity, nausea, or altered states of awareness; and
You voluntarily assume all risks associated with participation in ceremonial practices and agree to hold Kayla Anderson harmless from any claims arising from your participation.

Kayla Anderson reserves the right to decline your participation in any ceremony if she reasonably determines that participation may not be safe or appropriate for you.

8.3 Cancellations for Events

Cancellations for in-person or ticketed events must be made with at least [INSERT] hours'/days' notice to receive a transfer or credit. Cancellations made after this period may forfeit the ticket fee. No refunds will be issued for in-person events unless required by Australian Consumer Law.

8.4 Photography & Likeness at Events

Please refer to Section 15 (Photography, Video & Likeness) of these Terms for details regarding photographs and recordings taken at in-person or live online events.

9. PROGRAMS & DIGITAL PRODUCTS

9.1 Access

Upon purchase, you will be granted access to the Content as described at the point of sale. Access periods, platform details, and Content inclusions are specified at the time of purchase.

9.2 All Sales Final

All purchases of digital Products are final. Due to the immediate digital delivery and intellectual property nature of these products, no refunds will be issued except as required by applicable Australian Consumer Law.

9.3 No Sharing or Resale

Products are licensed for the sole personal use of the purchasing individual. You may not share access, login credentials, or any Content from these products with any other person, nor may you resell, reproduce, or redistribute any Content.

9.4 Payment Plans for Products

Where a payment plan is offered for a Product, you acknowledge that all instalments are payable in full regardless of whether you complete or access the program. Accessing even part of the Content constitutes acceptance of this obligation.

10. PAYMENT TERMS & PAYMENT PLANS

10.1 Accepted Payment Methods

We accept payment via Stripe, credit card, or such other payment methods as specified at checkout. All prices are displayed in the appropriate currency unless otherwise stated.

10.2 Payment Plans

Where a payment plan is offered, the following terms apply:

You authorise the Company (via our payment processor) to charge your nominated payment method on the agreed schedule without requiring further approval for each instalment;
It is your sole responsibility to ensure sufficient funds are available on each due date;
If a payment fails, you must contact us within 24 hours to arrange resolution;
Failed payments may result in immediate suspension of access to Services until resolved; and
You may not withdraw from a payment plan once you have commenced participation in or accessed any part of the Services.

10.3 Payment Default

In the event of a Payment Default (failure to pay within 72 hours of a scheduled instalment):

Access to Services may be immediately suspended;
You remain liable for all outstanding amounts under the agreed payment plan;
Interest may accrue on unpaid amounts at a rate of 10% per annum from the date of default until full payment is received;
If the default remains unresolved for 30 days, we reserve the right to refer the outstanding debt to a third-party collection agency, and all associated costs will be added to the outstanding balance; and
We reserve the right to pursue any and all legal remedies available to us under Australian law.

10.4 Price Changes

We reserve the right to change the pricing of any Service at any time. Price changes will not affect payments already made for Services purchased prior to the change.

11. REFUND POLICY

We have a firm no-refund policy across all Services, for the following reasons: our Services involve significant preparation, personalised support, and the delivery of intellectual property and experiential content that cannot be "returned."

Specifically:

Digital Products: All sales are final and non-refundable due to immediate digital delivery.
Group Programs (e.g. Beyond, Heart-Led): No refunds will be issued once access to the program has commenced.
1:1 Coaching: No refunds will be issued on payments already made. Remaining instalments are still payable as contracted.
Ceremonies, Retreats & Events (e.g., Cacao Ceremony, Sacred Socials): No refunds will be issued after the cancellation period outlined in Section 8.3.

Nothing in this clause is intended to limit or exclude your rights under the New Zealand Consumer Law, including your right to a refund where Services are not provided with due care and skill or are not fit for the described purpose.

12. HEALTH, SAFETY & CEREMONIAL DISCLAIMER

12.1 Participant Health Responsibility

By participating in any Service — particularly ceremonies, somatic practices, and breathwork — you confirm that:

You are in a physical and emotional state that allows you to safely engage with these practices;
You have consulted with a qualified healthcare provider if you have any medical conditions, injuries, mental health diagnoses, or concerns about your suitability for these practices; and
You have disclosed to Kayla Anderson any relevant health information prior to participating, including but not limited to: cardiovascular conditions, pregnancy, history of psychosis, current medication (particularly MAOIs or antidepressants), and significant trauma.

12.2 Ceremonial Practices Disclaimer

Participation in sacred ceremonies, including Cacao Ceremony, may produce intense physical, emotional, and energetic responses, including but not limited to: emotional release, heightened sensitivity, altered states of awareness, nausea, or physical sensations.

Ceremonial cacao is CONTRAINDICATED (not recommended and potentially unsafe) for individuals who:

Are pregnant or may be pregnant;
Have cardiovascular disease or uncontrolled heart conditions;
Are taking MAOIs or antidepressants;
Have a diagnosis of schizophrenia, bipolar disorder (type 1), or active psychosis;
Have been advised by a medical professional not to engage in such practices; or
Have severe PTSD or are in acute trauma crisis (please discuss with Kayla before participating).

If any of the above apply to you, you must disclose this to Kayla Anderson before participating. Kayla reserves the right to decline your participation if she deems it unsafe.

12.3 Not Medical or Therapeutic Treatment

All Services provided by Kayla Anderson — including coaching, ceremonies, energy work, and group programs — are offered as complementary wellness and personal development tools and are NOT a substitute for medical, psychiatric, or psychological treatment. No warranty or guarantee of therapeutic outcomes is made.

12.4 Assumption of Risk

By participating in any Service, particularly ceremonial and somatic practices, you voluntarily assume all risks associated with that participation and agree to hold Kayla Anderson harmless from any claims arising from your participation, to the fullest extent permitted by law.

13. EMERGENCY CONTACT & MEDICAL DECISIONS

For all in-person events, ceremonies, workshops, and immersions, you are required to provide a valid emergency contact name and phone number at the time of registration.

In the event of an emergency, Kayla Anderson reserves the right to contact your emergency contact and/or seek external emergency medical support as she deems necessary in her reasonable judgment. You agree to hold Kayla Anderson and the Company harmless for any decisions made in good faith in emergency situations.

14. CONFIDENTIALITY

14.1 Our Commitment to You

All personal information, health disclosures, and personal sharing that occurs within 1:1 coaching sessions and private communications will be held in strict confidence by Kayla Anderson and will not be shared with third parties without your express consent.

14.2 Exceptions

Confidentiality will be broken where Kayla Anderson reasonably believes there is:

An immediate risk of harm to you or another person;
A legal obligation to disclose (e.g., subpoena); or
A regulatory or child safety obligation to report.

14.3 Group Confidentiality

For group programs, ceremonies, and events, all participants are expected to maintain the confidentiality of personal information shared by other participants within the group container. What is shared in the container stays in the container.

14.4 Kayla Anderson Is Not a Therapist

Kayla Anderson operates as a coach and ceremony facilitator — not as a registered psychologist, counsellor, or therapist. The professional confidentiality obligations applicable to registered mental health professionals do not apply in the same way; however, Kayla is committed to upholding the highest ethical standards of discretion and care.

15. PHOTOGRAPHY, VIDEO & LIKENESS

By attending any in-person or live online event, ceremony, workshop, masterclass, or session hosted by Kayla Anderson, you acknowledge and agree that:

Kayla Anderson or her team may take photographs and/or video recordings during the event;
You grant Kayla Anderson an irrevocable, royalty-free licence to use your image, name, voice, and likeness in such recordings for marketing, promotional, educational, and social media purposes; and
Such Content may be published across social media platforms, the Company website, email marketing, and other promotional channels.

If you do NOT wish to be photographed or recorded, you must notify Kayla Anderson in writing prior to the commencement of the event. We will make reasonable efforts to accommodate this request, however we cannot guarantee exclusion from all group content.

16. USER-GENERATED CONTENT & SOCIAL MEDIA

16.1 Testimonials & Social Sharing

By sharing a testimonial, review, or feedback (written, audio, or video) with Kayla Anderson, you grant the Company permission to use and publish that content across all marketing and promotional channels, with attribution to your first name (or as agreed).

16.2 Community Standards

Participation in any online community space (Kajabi, Slack, Facebook, Circle, Telegram, or similar) associated with our Services is subject to the following:

You agree to engage respectfully and constructively with all other members;
You will not share, promote, or sell your own products or services within community spaces without express written permission from Kayla Anderson;
You will not record, screenshot, or share other members' content or personal shares without their express consent;
You will not post content that is offensive, discriminatory, hateful, or harmful; and
Violation of community standards may result in immediate removal from the community without refund.

17. PROHIBITED ACTIVITIES

When using our Services, you agree NOT to:

Use the Services for any purpose that is unlawful, fraudulent, or harmful;
Impersonate any person or misrepresent your identity or qualifications;
Attempt to gain unauthorised access to any part of the Services or associated systems;
Use automated tools, bots, or scripts to access or extract Content;
Interfere with or disrupt the proper functioning of the Services or any other user's experience;
Circumvent any technical measures used to protect Content;
Use the Services to harass, intimidate, or harm another person;
Post or transmit any malicious content, spam, or unsolicited communications; or
Use the Services in a way that competes with Kayla Anderson or the Company.

Any violation of this clause may result in immediate termination of your access and, where appropriate, referral to relevant authorities.

18. LIMITATION OF LIABILITY & INDEMNIFICATION

18.1 Limitation of Liability

To the fullest extent permitted by Australian law, Kayla Anderson and the Company shall not be liable to you or any third party for:

Any indirect, incidental, consequential, special, or punitive damages;
Loss of data, income, profits, or business opportunities;
Emotional distress or mental harm arising from participation in the Services (beyond what is covered by our duty of care);
Any physical injury, accident, or harm occurring during in-person or online events, where you have assumed responsibility for your own safety; or
Technical failures, outages, or errors on third-party platforms used to deliver the Services.

Where liability cannot be excluded by law, our total aggregate liability to you for any claim arising from the Services is limited to the total amount paid by you for the specific Service to which the claim relates.

18.2 New Zealand Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the NZ Consumer Law (NZCL) or any other applicable consumer protection legislation. Where the NZCL applies, our liability is limited to: re-supplying the Services, or paying the cost of having them re-supplied.

18.3 Indemnification

You agree to indemnify, defend, and hold harmless Kayla Anderson, her employees, contractors, agents, and affiliates from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

Your breach of these Terms and Conditions;
Your violation of any applicable law or third-party rights;
Your use of the Services in a manner not authorised by these Terms; or
Any misrepresentation made by you in connection with the Services.

19. THIRD-PARTY PLATFORMS

Our Services may be delivered through or make use of third-party platforms including but not limited to Kajabi, Zoom, Voxer, Slack, Telegram, Circle, Stripe, and PayPal. We are not responsible for the availability, functionality, or policies of these third-party platforms. Your use of these platforms is subject to their respective terms of service.

We do not endorse and are not responsible for any third-party products, services, links, or content referenced in the course of delivering the Services.

20. PRIVACY POLICY

By using our Services, you agree to our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy governs the collection, storage, use, and disclosure of your personal information in accordance with the Privacy Act 2020 (NZ) and applicable Privacy Principles.

Our Services are hosted and operated in NZ. If you access the Services from outside NZ, your personal data may be transferred to and processed in NZ.

21. ELECTRONIC COMMUNICATIONS

By purchasing or accessing any Service, you agree to receive electronic communications from Kayla Anderson, including but not limited to: program updates, scheduling information, payment notifications, marketing communications, and other Service-related notices.

You agree that all agreements, notices, disclosures, and other communications provided electronically (via email or otherwise) satisfy any legal requirement for written communication.

You may opt out of marketing communications at any time by using the unsubscribe link in our emails. Please note that Service-related communications (such as payment reminders and program updates) are not optional and will continue while you are an active participant.

22. MODIFICATIONS & INTERRUPTIONS

Kayla Anderson reserves the right to modify, update, suspend, or discontinue any aspect of the Services at any time, with reasonable notice provided where practical. This includes changes to program structure, delivery format, call schedules, inclusions, and platform used.

We reserve the right to update these Terms and Conditions at any time. The updated Terms will be posted on our website with a revised effective date. Continued use of our Services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

We are not liable for any Service interruptions caused by circumstances beyond our reasonable control, including but not limited to: illness, technical outages, natural disasters, or force majeure events. In such circumstances, we will make reasonable efforts to reschedule or otherwise accommodate affected participants.

23. TERMINATION

23.1 Termination by Kayla Anderson

Kayla Anderson reserves the right to terminate or suspend your access to any Service, without refund, in the event of:

A breach of any provision of these Terms;
Conduct that Kayla Anderson reasonably determines is harmful, disruptive, or unsafe to other participants or the container;
Fraudulent payment or misrepresentation; or
Any other circumstance where continued participation is not in the best interests of the group or the Services.

Termination does not release you from any outstanding payment obligations.

23.2 Termination by You

If you choose to discontinue participation in any Service:

You must notify Kayla Anderson in writing;
No refund will be issued for amounts already paid; and
If you are on a payment plan, all remaining instalments remain legally payable as contracted.

24. GOVERNING LAW & DISPUTE RESOLUTION

24.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. The parties irrevocably submit to the exclusive jurisdiction of the courts of New Zealand.

24.2 Dispute Resolution

In the event of any dispute arising from these Terms or the Services, the parties agree to:

First attempt to resolve the dispute through good-faith informal communication. Please contact us at connect@lovewithkaylaanderson.com to raise any concern.
If the matter is not resolved within 14 days of written notice of the dispute, the parties agree to attempt mediation before commencing any formal legal proceedings.
If mediation fails, either party may pursue the matter through the courts of the applicable jurisdiction.

Nothing in this clause prevents Kayla Anderson from seeking urgent injunctive or equitable relief from a court where necessary to protect intellectual property or confidential information.

25. GENERAL PROVISIONS

25.1 Entire Agreement. These Terms, together with your Program Agreement or Client Agreement (where applicable) and our Privacy Policy, constitute the entire agreement between you and Kayla Anderson with respect to the Services and supersede all prior agreements, representations, or understandings.

25.2 Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.

25.3 No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

25.4 No Partnership or Agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Kayla Anderson.
